my tenant has a mouse in her unit,is my responsability to get rid of it as landlord?
My tenant that live below me street level called me that she has a mouse on her unit she also told me she has seen roaches.
I’ve done two pest control in one month since I noticed there were a lot of ants in the back of the house, the first time she called me for the roaches I noticed her unit was not clean, the dishes were not done the trash can was not cover and she had a lot of food everywhere, I told her to make sure she keep everything clean and the food in closed containers. when I followed the line for the ants they were all going to her thrash can she also had a bucket with empty cans, I kicked it accidentally and a lot of roaches came out of it so I told her about it.
Now she call again about the mouse and seen roaches. I noticed now she has the bucket with empty cans inside her kitchen. I looked at her lease and it doesn’t say I’m responsible for her pest control. I would if there would be an infestation to be treated. but I think she should take care of it. before ir become and infestation, am I responsible to get rid of the mouse ? I am a landlord in Oakland Ca.

You are responsible to see that there are no insect or rodent infestations in or around the unit. This can be controlled by a periodic pest control service(usually serviced quarterly). After you have the first service done you need to send the tenant a certified letter stating that it is her responsibility to keep her apartment clean and free of garbage and trash which attracts insects and rodents and that she is responsible for any extermination problems that may arise between the quarterly professional treatments.
