Help, I live in a “slum” and the management won’t fix anything!!!?
We rented an Apartment in Sept of 2009, the lease is for 13 months so it will end in October 2010. When we moved in here we notified the management of problems with the apartment. The whole apartment next door had flooded and seeped through the walls I had black mold all over my living room wall and laundry room wall, the side of our apartment that is sharing a wall with that apartment has a musty smell. They sprayed bleach on my walls and told me to paint over it in the color I wanted (my fiance is a painter), the front door has sealing problems water comes in when it rains and small animals come in under the door, the roof leaked horribly when the floods happened and it caused mold in the upstairs bathroom, after alot of phone calls to the Office and numerous visits, and my getting sick, they finally came and sprayed the walls with bleach and then sprayed Kilz on it. The ceiling had got a hole in it from so much water coming in, they did fix this when they sprayed bleach but, not before I saw all of the black mold in the ceiling, now often I have to call them out to spray their bleach because the mold comes through, I have asthma and have been sick since we moved in. When we moved in we were also told that if we have pest problems to notify them, I have notified them 10 times and one time someone came out but, I was not home. When I got home and saw the notice on my door, I called the office and the lady who answered told me and I quote “before I started raising hell about pest control not getting in, they don’t have a key” The manager had a key when we moved in because she gave us 1 key and said that she would get us another one as soon as maintenance had a copy made. the key was misplaced and I was told to get a copy made to furnish them with one, I requested that they change my locks because, they don’t know where my key is and it has my apartment number on the key ring. After going back and forth with the manager they finally agreed to change it but, that was 3 weeks ago and nothing yet. I also notified them about the furnace not heating my apartment if I don’t have the thermostat on 90, maintenance came out and said the thermostat doesn’t work and they would order a new one but, that was almost 2 months ago. I am having problem after problem with these people and they won’t fix anything. I am extremely worried about the mold issue and the roach problem (it keeps getting worse and worse). Is there anything I can do, to make them fix these problems or to get out of the lease so I can move to a better place? Please help me with this, I have 2 kids and they are also having bad allergy problems since we moved here.
So, can I break this lease without it damaging my credit and if so, how do I do it?
Yes I did look at the apartment and it didn’t have any issues but, the door was obvious and I was told it would be fixed, no roaches that was noticable, everything was noticed after we moved in.
The leaking started a week after we moved in when it started raining and of course that lead to the mold. The water leak on the other apartment showed up 3 days after we moved in. I wike up one morning and the carpet was soaking wet in the livingroom and my walls were stained and by the next day there was mold on the walls.

First, did you LOOK at the apartment before you leased it?
What you can do is, call the health department and have them come out. They will start an escrow account for you. An escrow account will have you pay rent, but will not allow the owners to touch it until they fix it.
If you don’t want to live there, tell the health department your health problems, and maybe they can help you on breaking the lease.
